These Terms of Service (“Terms”) govern access to and use of the nilAI website, APIs, models, software, documentation, and related services (collectively, the “Services”), provided by Nillion Association, a Swiss company (“Nillion,” “we,” “us,” or “our”).

By accessing or using the Services, you (an individual acting in a professional capacity or an entity) agree to be bound by these Terms. If you do not agree, do not access or use the Services.

We may update these Terms from time to time. The “Last Updated” date reflects the effective date of the current version. Continued use of the Services constitutes acceptance of the updated Terms.

1. License to Use the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely in accordance with these Terms. No rights are granted except as expressly stated.

2. Eligibility and Enterprise-Only Use

The Services are offered exclusively for business, enterprise, and professional use. By using the Services, you represent and warrant that:

• You are acting on behalf of a legal entity or in a professional capacity
• You are not a consumer within the meaning of applicable consumer protection laws
• You have authority to bind the entity you represent

Consumer withdrawal rights, cooling-off periods, and similar protections do not apply.

The Services provide programmatic access to artificial intelligence models and computation via APIs and related interfaces. The Services operate on a prepaid, usage-based credit system. Credits are consumed based on actual usage of the Services.

4. Software Updates and Changes

We may update, modify, or change the Services at any time, including:

• Adding or removing features
• Changing APIs or endpoints
• Modifying performance or behavior
